what happens when a cop arrests and books you without reading you your rights?
Q. this happened to a friend of mine a couple of days ago, for drinking a beer at the beach. they harassed all of us, tried to intimidate us into claiming the alcohol and never read any rights.

A. Miranda is only required if: 1). You are in custody (i.e. under arrest) and, 2). being questioned about a crime. If those two elements are not present then Miranda is not required. Miranda is very rarely read to people who are arrested for minor on view crimes. If you see someone drinking illegally then what do you need to question them for? Even if the Officer did question your friend once he arrested them without reading them their rights all that means is that nothing they said can be used against them. The Officer can still testify to what he saw and what your friend said prior to being arrested. Miranda is one of the simplest aspects of Law Enforcement and (thanks to TV) one of the most widely misunderstood. This is a very… [cont.]
