What are child abandonment laws in regard to leaving a child alone in a public place?
Q. A 5-year-old child is left alone at table in the mall for 5 or 6 hours. This parent has no contact with the child during that time and isn't even necessarily nearby (not within seeing or hearing distance). What are the laws for that child? Is that considered abandonment? Could a parent get arrested for that? Fined? What would happen?

How does child support work when father is deployed to iraq?
Q. My son's father is being deployed to Iraq in May, but leaves in March for his training. Child support is already court ordered, but I know that there will be a huge increase in his pay once he leaves. What should I do about getting child support increased? Should I contact his national guard unit or child support enforcement now or should I wait? If I wait until he has gone, how do I show his income? He is ordered to pay, but has just started to pay because he will most likely to have to serve 30 days before he leaves. His court date is on the 18th for that. He is over 3000 behind already. He is in the national guard so when we processed the orders he was working a minimum wage job. His pay will increase.

A. the increase in pay we get over there is not our real salary so they never go by that. although since he will be getting regular active duty pay u should hit him up for that. and the army CAN enforce the child support order. your child is entitled to all of the servicemember's BAH. when my husband was deployed i didn't get a dime and his unit told me they can't enforce it with no court order! i too am in army and know that's not true.

Does a child with legally adopted parents have any rights to the First parents estate upon death?
Q. I know that adopted children have rights for adoptive parents as true and full children as any child born to you. They are equal in the eyes of the law for adoptive parents. But what about First parents? Maybe they had their child taken, or they "gave" their child up, but are in reunion happily. The mom doesn't change her will because she doesn't think about it. Does the child have the same or any rights to personal items or monies as any children born and raised by the First mom? Just wondering.

What will happen to a child taken from her mother due to drug abuse?
Q. Someone I know used drugs before, during, and after her pregnancy. Her daughter was born with a drug addiction and is still in the hospital (3 weeks). If reported, I assume the child will be taken away, but will the family be able to take custody of the child legally? Or does the child HAVE to go into a foster care setting? A. well, first off, the child was tested in the hospital and if so, the social workers are already involved. chances are, the mother will have to clean up her act. the child will also go to family first before entering the foster care system. a child born addicted to drugs has many things that can go wrong. especially a bit later, like during the school years.

Q. A judge ordered child support to be paid by my ex. The order was dated June 24th of this year. So far my ex has still not paid a penny of child support (three months after the court order was put in). He is already in arrears (my child is over a year old now). A. I would use a social story with him...they are simple short stories that help the child learn to self monitor his behavior. I would also try a token system of reinforcement, something that you can show him easily and discreetly to let him know that he is displaying appropriate behavior, keeping hands and feet to self, for a small discreet reward. If he does start to have a tantrum or start to display negative behaviors and can't calm down try removing him from the situation, and letting him have a small area, "break room" where he can deal with his frustrations. hope this helps, i included links for information on social stories.

A. These people are so dumb. Okay - how did the support even start in the first place? Because there was an order from the decree. That same decree also states the stop date (s). However, how does the state know your case from a zillion other ones? Contact them in writing that they have the correct date(s). You do not need to go back to court. It is already all there! And it stops.

A. If you go to the courts and get a petition for child support set up they will use what they call a formula, where they take your income and the minimum he should be making and calculate it. What ever the calculation comes up with he will be made to pay. Just because he doesn't have a job doesn't mean he's going to get off with not paying it. If that were the case, then all these people out here that have to pay child support would quit their jobs and not worry about it. I'm not sure what the lowest limit is for your state, but my child's father was ordered to pay $130/month. Of course he hasn't paid that and his excuse is that he doesn't have a job. Now he owes $2500 and is about to be sent to jail.

A. I have one son who is 5 and he is constantly saying how he wants a little brother and is always watching commercials that have baby toys in them. He always tells me how he wants to get it for his little brother, my husband and i have been trying to conceive for two years and we miscarried a couple of months ago. A. It depends on how you filled out the injured spouse form. When you fill out the form, you allocate children and other credits and deductions to one spouse or the other. If the child is assigned to you then you will get the child tax credit. If the child is assigned to your husband then it goes to pay back his offset. For the injured spouse form to be beneficial, you should always assign as many good things (like children) to the injured spouse as possible. Children can always be assigned to the injured spouse even if the child was not your biologically, since the child became yours as soon as you married its father.

A. Child Benefit is a universal benefit paid to anyone whilst Child Tax credit is means tested. Both are payable provided the young person is under 20 (not 18) and is in full time non advanced (upto "a" level" standard) education or certain types of training. Given your circumstances you should be receiving/claiming Child Benefit and the same with tax credits, athough tax credits is means tested (you have to be on a very high income to get nothing by the way)

A. Plenty of people have herpes without ever knowing it. Sometimes there aren't any symptoms. If they have ever gotten cold sores, that's a sign of herpes. A mother could pass herpes on to her child even if she wasn't having an outbreak. i think it's called asymptomatic shedding or something, but it's not likely especially if her doctors put her on medication just before she gave birth. But she should have her kids get a blood test just to make sure so they don't accidentally infect anyone else.

A. My kids are 11, 10 and 7. We include a wide variety of foods in their diets. Usually what's in season (fruits and veggies) and what we can get out of our own garden. I prefer whole foods--nothing processed. But, we do end up having that once and a while. I truly do not believe any natural food is bad for you--as long as it's in it's natural form (again, not processed) and in moderation. We have treats once and a while. Depends what is it. A. It will NOT be advantageous to file mfs. Be sure you aren't using the "single" tables - you can't do that, you have to use the mfs rates. It is only under very rare circumstances, like one of you has very high medical bills or unreimbursed employee business expenses, that it even MIGHT be better to file as mfs rather than joint. If your incomes are pretty close together, and you aren't eligible for any of the credits that you can't take under mfs (it's not just EIC) then it might only cost you a few extra dollars. But if you file as mfs, either of you can claim the child but not both - if you can't agree, it goes to the person with the higher AGI.
