What are the benefits of living on residence ?
Q. I am able to pay for my first year of residence for university. My parents however, are dead set against me living in residence. I am writing an essay for them, stating why it would be beneficial for me. I have some of the points, but does anyone have any tips of what to say ? Thanks so much. (:

I feel like a lot of commuter students kind of miss out, because they are paying for all these things like student health center fees, athletic fees, library fees, etc and rarely use them since they live off campus. Also, if you live on campus, you have more motivation to use resources at your disposal. When you convert your investment property to primary residence are you required to notify your lender and refi?

A. Residence loans are normally a longer term, up to 30 years, and a lower rate. So if you have a investment property that you have now decided to make you primary residence I would check with the bank and see if you could refi it. It will probably save you money. However you are not required to. As for doing it the other way primary residence to investment property? I know several people that will buy a home fit it up while living in it for the required 2 or 3 years and then turn it in to a rental home and buy another home.

How early can I have my Dubai residence visa renewed by my company?
Q. It's expiring October but I need it renewed now so I can apply for a France visa, which requires the residence visa to be valid for at least 6 months from the date of return from France. My boyfriend wants to become a doctor and he'd like to go to Dalhousie, how long does he have to live there to become a residence since apparently it's a lot easier to get into med school if you live there. Q. My contractor is telling me that it is 'standard' when creating an access door to my new addition that they not provide access TO the door - ie steps. Therefore I incurred a $2000 change order to have steps to access the back door. I thought that a residence had to have a minimum of 2 ways in/out - therefore, they must provide access to the second door to meet code. Am I way off??

How do I place a lien on the title of a residence?
Q. I live in California - my father recently passed and put his 1/2 community property interest in a life estate within a family trust. The trustee has a life estate with the remainder going to myself and two brothers. We are concerned that the current trustee of the family trust will attempt to sell the residence and leave town without paying us our share. Is there anyway to place a lien on the residence title, so that if she attempts to sell the residence - we will know and be able to take steps to ensure that we get paid? A. To ease your mind, rest assured, a life estate is NOT ownership. It is simply a guarantee of useage of a property until the occurance of some event, which is the death of the trustee. When that person dies, it automatically skips probate and goes to you and your two brothers The Trustee, however, can terminate the life estate at any time, but the ownership still reverts back to you and your brothers. How can I get a work/residence permit for the Netherlands?

Q. I am 22 and have a 3 year old daughter and would like to get a job in the Netherlands so that I can use that to get a residence permit and a work permit. It seems simpler to have a company request the paperwork than to go there and do it yourself, you get much quicker results that way and more often than not a positive reply. I am fluent in Dutch, (reading and writing and speaking) so I'm hoping that will help me. Also, does anyone know how to go about getting a divorce (from a canadian marriage) when living in the Netherlands? Can that be done via fax or mail? Can anyone help? Thanks so much!

A. If you're literate in dutch, do you have dutch ancestry? then you can get a family reunification visa. Very expensive but easiest way. Otherwise if you can get a job paying over 45K euro then you can apply for highly skilled worker visa. Check the IND (Immigration & Naturalisation Service). If my permanent residence is VA, but I worked in NJ over the summer, how do state taxes work?
Q. I'm a part-time student who's permanent residence is in VA. My wife and permanent residence remained VA while I worked/lived in NJ over the summer. They obviously withheld NJ income taxes, however, I am entitled to get those back, correct? How does taxation work? So which is it? Also, NJ/VA aren't reciprocal states I don't think, so I don't think your info about a credit is correct.

A. You are not entitled to all of them back. You may or may not be entitled to some of them bank. You must file file an NJ nonresident income tax return to see how much is refunded and how much NJ keeps. You then report all your income on a VA return, and claim a credit on your VA tax return for however much NJ kept, or for the VA tax on the NJ income, whichever is less.

rental converted to primary residence, how many years do you have to live there to avoid capital gains as 2nd ?
Q. - sold 1 resident & 1 rental - use the proceed to buy 1 primary residence - sold that one and bought another smaller place as primary residence so how long do you have to live in the last house to avoid capital gains tax? I really need the website that details the rules. All i can find is for the simple one conversion.

A. 5 years to protect it all. Anything less is prorated, with a minimum of 2 years with a proration of 40%. (you only pay tax on 60%) The prorating is fairly new, anyone who has not sold for awhile may not realize it. There were too many tax cheats, the IRS cracked down.
