What is the typical sentence for baby rape by a Naval enlisted person in the state of South Carolina?
Q. My sister's 2 year son was brutally raped by his father. The father is in the Navy and they are located in South Carolina. I am trying to find out what is the typical sentence. We are terrified that this man may only get 10 years - and potentially less, as this is his first offence. Also, if you have any web resources that we may reference to research what we can do to attempt to get the longest possible sentence, it would be most appreciated.

A. If the physical evidence against him is incontrovertible, and he cannot offer a defense of actual innocence (that is, if the evidence is so strong that there is no way he can reasonably argue that he didn't do it), he will probably claim a mental defect or incapacity. In South Carolina, this defense is not likely to succeed in getting him acquitted. However, it is possible that such a defense will assist him in plea negotiations before trial, and will affect sentencing after trial, particularly if he really is crazy. My guess is that he will negotaite a plea bargain. He will probably agree to plead guilty in exchange for either a reduced prison term, or the possibility of serving out his sentence in a state mental facility rather than a… [cont.]

What will my sentence likely be for shoplifting?
Q. At the beginning of the month, I tried to walk out of a Zumiez with a pair of shoes in order to impress my friends and they caught me and I served 1 day in jail (I'm 19). I have a court date on Jan. 4th and I just need to know what will transpire in the courtroom exactly and how I can get the most minimal sentence possible. All advice/information is greatly appreciated.

A. Ian - I am an attorney and I know a lot about this subject. Do not take this as creating an attorney-client relationship. You may, however, find it helpful. Your question is very similar to another one I answered recently. Obviously, first and foremost, you should appear in court at the appointed time. Dress well but conservatively. Clothes appropriate for an office would be best. Be humble and polite. Don't confess. Before the hearing you should consult with a lawyer experienced with criminal matters. If you cannot afford an attorney, contact the public defender's office and ask them how you can request that a lawyer from their office can be appointed to represent you. What's the shortest sentence a person could get for kidnapping?
Q. Don't worry, I'm not planning to kidnap a child, but I'm writing a fiction piece where a little boy gets kidnapped by a couple, and then is raised by them for a few years. Does anyone know what the easiest possible sentence will be on them when they get caught? You have been so helpful so far, I didn't know about the state lines. What if he was taken from California to Idaho?

A. Depends on where in the world the person is prosecuted. In parts of the middle east, kidnapping is a legitimate business negotiating technique. In the u.s. it can be either a state crime or a federal crime. In my state, the minimum would be five years in prison.
