What are the tax filing requirements for a final return?
Q. What are the tax filing requirements for a final return? A spouse of a friend of mine passed away this year. I believe that last year, they filed under the status of Married, filing jointly. From what I've read from the internet and Yahoo Answers (thx!) that she can probably file again as Married, filing jointly. I believe that her husband had a will and named a son (from a previous marriage) as the executor of the will. In that case, when she files, does the executor have to sign the return where her husband's name would usually be? Or can she still sign it as surviving spouse? Also, who's responsibility is it to prepare the final return, the surviving spouse or the executor? They really aren't in much speaking terms, so if they… [cont.]

A. She is entitled to file as "married filing jointly" in the year that her spouse died. So if her spouse died in 2006, this is the last year she may file jointly. For the next two years (2007 and 2008) she would file as "single", unless she had a dependent child then she would file as "qualifying widower with dependent child". She would sign the tax return. The executor does not need to sign for her deceased husband. She could file "married filing separately" also for herself for 2006 and have the executor file the deceased spouse's tax return. however, it is usually more beneficial to file a joint return.

A. Actually you can make donations to the government. Each department has rules on how you might do such a thing. The following link is for the Department of Commerce. It was just the first that I found so every Department will have something similar. You can not give anything to individuals nor may you give the intent of getting anything back (sort of like with taxes). However it would be much wiser if you were to put that money in some sort of savings plan. When you are "old" you will have lots of money and will not need to be dependent on the government.

A. She'll have to apply for An Individual Taxpayer Identification Number for tax purposes. Form W-7. And then file a 1040 income tax form. In most cases, however, the money the IRS withheld can be used as a tax credit against any income taxes her own country imposes.

A. First of all, you can only deduct a charitable contribution if you itemize, so if you don t itemize, there s no tax benefit to you from the donation. Charities usually sell donated cars at auction, and they ll give you a receipt for the car showing how much it sold for that s the amount you can deduct. Be aware that cars being auctioned usually sell below what would be fair market value. The tax benefit from the deduction is at most the amount of the deduction times your tax bracket. So if they sold the car for $3000, and your tax bracket is 15%, your tax savings would at most be $450. This is for federal taxes, so the rules are the same in every state of the US.

How do I amend a tax return to reflect a change in social security income?
Q. I am trying to help out a relative who accidentally listed their monthly social security amount instead of the yearly on their 2007 tax return. None of the social security is taxable, but she was disqualified from a stimulus payment because the amount she put on her taxes was under $3000. A. Call 800-555-1212...ask for the louisiana dept of taxation and finance. When you call, tell them you need a non resident tax packet. They will send it to you with the instructions. Many states have an income limitation where you may not have to file a return. Ask what is the minimum for filing. You can also have a professional preparer do this but it will cost a fortune. The Louisiana Dept of Taxation will guide you through this if you have questions. Also, many states have tax forms on line so you can file on line. You might want to ask them if you can do this and ask for the web address.

A. It is an advance of your refund for 2008. When you file your 2008 taxes in 2009, you will have to pay it back. Overall, I think that it is a bad idea. It will not affect your tax return that you file for 2007. Do not count on getting this money until it has passed both houses of Congress.

If a civil case forces you to return prior income, can you adjust your previous tax returns?
Q. Say my business make 100k this year. And next year, a civil suit claims that income was an ill-gotten gain, and I have to settle and return the 100k I made. If you properly reported the income in a prior year, and it was determined that the income was paid to you in error, you may be able to recover the taxes paid on the repaid income by filing a "claim of right" to recover taxes paid on income you had to repay.
